EHS Participant Consent and Liability Waiver
PLEASE READ CAREFULLY
Any Person(s) registering for an Event, Program, or Service from the EliteHockeySkills.com website and selecting the checkbox to continue (herein referred to as "Participant"), agrees fully to the terms listed in this Participant Consent and Liability Waiver, including the refund policy, and is registering as the Parent or Legal Guardian on behalf of a child (herein referred to as "Player Participant").
The Participant fully understands and acknowledges the inherent risks involved in hockey programs operated under EliteHockeySkills.com and Coach Dan (herein referred to as "EHS" or "Daniel McNamara"). These include, but are not limited to, dangers and risks associated with ice hockey and off-ice fitness training, such as injuries caused by pucks, skates, sticks, collisions with persons or objects, training equipment, rink boards, glass, or variations in ice surfaces.
Further risks include vigorous physical exertion, rapid movements, quick turns and stops, strenuous cardiovascular activities, and physical contact with other participants both on and off the ice, potentially resulting in bruises, sprains, cuts, breaks, dislocations, head and facial injuries, dental injuries, eye injuries, and spinal cord injuries which could result in permanent paralysis.
The Participant acknowledges that adhering to EHS rules reduces the risk of injury.
On behalf of myself, my heirs, and legal representatives, I hereby release, indemnify, and agree to hold harmless EHS, its sponsors, promoters, directors, officers, representatives, employees, agents, volunteers, participants, and all on-ice persons from any and all claims, demands, rights, actions, causes of action, losses, costs, damages, and liability of any kind, including negligence claims, resulting from personal injuries, property damage, death, or other damages occurring during participation in any EHS Event, Program, or Service.
I hereby consent to and authorize EHS to seek emergency medical treatment for the Player Participant if injured during participation in any EHS Event, Program, or Service. I acknowledge my responsibility for all medical costs associated with such emergency treatment and agree to hold harmless EHS, its sponsors, promoters, directors, officers, representatives, employees, agents, volunteers, and participants from any claims related to emergency medical treatment administered.
The Participant agrees that the Player Participant will adhere strictly to all EHS safety rules and regulations, including the proper use of required safety equipment and clothing.
I grant EHS permission to capture and use videos and photographs of the Player Participant for coaching, promotional, and publicity purposes. I relinquish any rights or claims related to the use of these materials and release EHS from all claims and demands for damages arising from their use.
Refund Policy:
EHS is a small business with contractual obligations and partnerships, including arrangements with local hockey arenas. Payments made to EHS for participation in any Event, Program, or Service are strictly non-refundable once accepted and paid, either in part or in full.
If serious unforeseen circumstances (e.g., significant injury or severe illness requiring hospitalization or documented medical treatment) prevent the Player Participant from attending, EHS may, at its sole discretion, consider partial refund requests or offer credit toward a future event. Such consideration is conditional upon:
- Immediate notification to EHS, at least 7 days before the Event, Program, or Service begins.
- Provision of official medical documentation (doctor's note or hospital records) clearly outlining the medical necessity preventing participation. Any associated costs for obtaining medical documentation are the Participant's sole responsibility.
- EHS's ability to fill the vacated spot with another paying Participant.
- Participant's understanding that minor illnesses or injuries that do not require documented medical attention (such as routine colds or minor aches) do not qualify for any refund consideration.
EHS retains the final authority to grant or deny any partial refund or credit request, evaluated strictly on a case-by-case basis.
